CLEARASIL BACKSTAGE PASS PROMOTION
OVERVIEW (NOT PART OF CONDITIONS)
Principal entry requirement: Entrants must purchase, from any retail outlet
anywhere in Australia, one Clearasil product ("Promotion Product")
Entry Period: opens at 9am on 01/02/2009 and ends at 5pm on 20/03/2009.
Entry method: by internet.
Prize Pool: The following prizes are available to be won:
(i) In the draw, one signed electric guitar valued at $500, and 3 CD Packs, each
valued at $400, and
(ii) a maximum of 30,000 downloadable songs each valued at $1.69, which will
be awarded to the first 30,000 entrants who submit, or are awarded, a valid entry
during the entry period.
Prize Pool Value: The total value of all drawn prizes is $1,700. If all 30,000
downloadable songs are awarded, their total value would be $50,700.
Prize Draw: The draw will be held at Suite 205, 22 Mountain St, Ultimo NSW 2007
and will commence at 3pm on 25/03/2009.
CONDITIONS
PARTICIPATION
1. This competition (“Competition”) is conducted by Reckitt Benckiser
(Australia) Pty Ltd, ABN 17 003 274 655, trading as Reckitt Benckiser, of 44
Wharf Road, West Ryde NSW 2114 (“Promoter”).
2. Entry to the Competition constitutes acceptance of these conditions. All entry
instructions and prize information published by the Promoter form part of these
conditions.
3. The Competition is only open to Eligible Entrants. An "Eligible Entrant" is
an individual who:
(i) is a resident of Australia; and
(ii) has either:
(a) been invited to enter by the Promoter (the invitation having been made
by the Promoter giving the individual a lanyard with an attached “Backstage
Pass” that bears a unique code) (a “Promoter’s Invitee”),
or
(b) has been invited to enter by an Eligible Entrant in accordance with the
provisions of these conditions (a “Friend”); or
(c) has not received either of the above invitations, and
(iii) is not an employee of the Promoter or any of its related corporations or
any of their agencies associated with the Competition; and
(iv) is not a spouse, defacto spouse, parent, child or sibling (whether full,
half, step or by adoption) of such an employee.
4. Competition entry opens at 9am on 01/02/2009 and closes at 5pm on 20/03/2009
("Entry Period"). All times and dates are times and dates in Sydney
which may be AEST or AEDT depending on the date.
ENTRY
5. To enter, an Eligible Entrant must purchase, from any retail outlet anywhere
in Australia, one Clearasil product ("Promotion Product").
6. Subject to the other conditions, an Eligible Entrant may enter the Competition
once and may be awarded up to 3 additional entries if they refer a Friend in
accordance with condition 15.
7. Entry can only be made by internet. To submit an entry, an entrant must
use a compatible browser to visit www.clearasilbackstagepass.com.au ("Competition
Website") and follow the directions there to provide all the required
details.
8. If an entrant is a Promoter’s Invitee, the required details will include
the unique code on the Backstage Pass given by the Promoter to that entrant.
9. For all other entrants, the required details will include the barcode number
of the Promotion Product that they have purchased, and may include the name of
the store from which the purchase was made, and the purchase date.
10. All entrants must ensure that their entries are received by the Promoter
during the Entry Period. The Promoter takes no responsibility for late or misdirected
entries or for any delays or failures in any telecommunications service or equipment.
11. An entrant who is a Promoter’s Invitee must retain their Backstage
Pass. All other entrants MUST retain that part of the packaging of the Promotion
Product that they used to submit their entry that bears the product barcode,
12. All entries to the Competition may be subject to verification by the Promoter.
The Promoter will reimburse an entrant for any reasonable costs incurred in complying
with this condition.
(i) An entrant MUST, within 7 days of being asked, deliver to the Promoter (by
a means determined by the Promoter) all of the items which condition 11 requires
the entrant to retain and which are requested by the Promoter. The Promoter may
elect not to return those items.
(ii) An entrant MUST also deliver to the Promoter (by a means determined by the
Promoter) copies of any other documents the Promoter may request establishing
eligibility to enter or win, including evidence of residence or identity. The
Promoter may make one or more requests for such documents. Once the identity
of documents available is established, an entrant must deliver requested copies
within 7 days of being asked to do so. At the Promoter's request, an entrant
MUST also, within 7 days of being asked, allow the Promoter to inspect and copy
the original of any such document.
13. The Promoter may, at its absolute discretion, declare any or all entries
made by and awarded to an entrant invalid if the entrant: (i) fails to establish
their entitlement to enter the Competition to the Promoter's satisfaction; or
(ii) fails to produce items as required by condition 11 or produces items that,
in the Promoter's opinion, are illegible, stolen, forged, reconstructed, altered,
incomplete or tampered with in any way; or (iii) in the Promoter's opinion, tampers
with the entry process or benefits from such tampering; or (iv) in the Promoter's
opinion, submits an entry which is not in accordance with these conditions.
14. An entry by more than one person (ie a joint entry) is invalid.
15. When submitting his/her entry, an entrant will have the opportunity to invite
Australian resident Friends who are also Eligible Entrants, to enter the Competition.
The Competition Website will generate and send an e-mail from the referring entrant
to each referred Friend, inviting each Friend to enter the Competition. For each
referred Friend who subsequently enters the Competition during the Entry Period
the referring entrant (if eligible to enter the Competition) will automatically
be awarded one additional entry into the Competition, up to a maximum of 3 additional
entries, subject to the following provisions:
(i) To determine whether a new entrant is another entrant’s referred
Friend (entitling the referring entrant to an additional entry), the Promoter
will match
the e-mail address given by each new entrant with the e-mail addresses to which
e-mails were sent inviting referred Friends to enter.
(ii) If the same person is referred as a Friend of more than one entrant, only
one additional entry will be made and it will be allocated to the entrant who
first referred that person.
(iii) If a referred Friend is already a Promoter’s Invitee, no entry
will be awarded for that referral.
(iv) Where an entry is awarded, the time at which the referred Friend’s
entry is received by the Promoter will be the time at which the entry is awarded
to the entrant.
INTERNET ENTRIES
16. Any costs associated with accessing the Competition Website are the responsibility
of the person seeking access and are dependent on the internet service provider
used.
17. Eligible Entrants must make their internet entries manually using an internet
browser. The Promoter may reject internet entries if it reasonably forms the
opinion that they have been entered using automated entry means or by use of
a competition entry service.
DRAW AND DRAWN PRIZES
18. The draw will be held at 3pm on 25/03/2009 at Suite 205, 22 Mountain St,
Ultimo NSW 2007.
19. The Eligible Entrants who submitted:
(i) the first valid entry drawn will win one signed electric guitar, valued at
$500;
(ii) the next 3 valid entries drawn will each win one pack of approximately
20 CDs of the Promoter’s choice. Each CD pack is valued at $400.
20. The total value of all drawn prizes is $1,700.
SONG PRIZES
21. One downloadable song prize (“Song”) will be awarded to each
of the first 30,000 Eligible Entrants whose valid entries are received or awarded
during the entry period.
22. As an Eligible Entrant can submit only one entry and can be awarded a maximum
of 3 entries for referred Friends (see condition 15), an Eligible Entrant can
win a maximum of four Songs.
23. Each Song is valued at $1.69 (inc GST) and if 30,000 Songs are awarded they
would have a total value of $50,700.
PRIZES GENERALLY
24. Each prize is valued as at 22/12/2008. The Promoter takes no responsibility
for any variations in value of a prize.
25. If a prize (or part of a prize) is unavailable for any reason, the Promoter
will, in its absolute discretion, substitute alternative goods or services of
no lesser retail value and/or specification, subject to the approval of the authorities
that have issued permits for the conduct of the Competition. The Promoter accepts
no other liability or responsibility for any loss incurred by a winner or any
other party if a prize (or part of a prize) is unavailable for any reason.
26. A right to receive a prize is not transferable or exchangeable and cannot
be taken as a monetary payment
WINNERS
27. Each winner will be notified in writing sent by e-mail to the e-mail address
indicated in the entry. The notification may include instructions as to how the
winner is to claim the prize and establish his/her entitlement to it.
28. The name of each winner of a drawn prize will be published in The Australian
on 08/04/2009.
29. Subject, where relevant, to any directions given under the legislation regulating
the Competition, if any drawn prize is not claimed by a winner within 3 months
of the draw, the prize will be awarded to another Eligible Entrant in a redraw
commencing at 3pm on 09/07/2009 at Suite 205, 22 Mountain St, Ultimo NSW 2007.
If there is a redraw, the name of each winner in the redraw will be published
in The Australian on 23/07/2009.
30. In order to be entitled to any prize, each winner must, if requested by the
Promoter, agree to and sign:
(i) an eligibility form confirming their compliance with the Conditions and eligibility
to accept the prize; and
(ii) a liability release, waiver and/or indemnity in favour of the Promoter and/or
any person or other entity associated with this Competition.
If a winner is under 18 years of age, the winner must ensure that his/her parent
or guardian agrees to and signs the documents referred to above on the winner’s
behalf (if requested by the Promoter). A winner will forfeit his/her prize
if he/she fails to ensure that all documents relating to that prize are signed
in
accordance with this condition, as and when required by the Promoter.
GENERAL
31. If for any reason the conduct or operation of the Competition is interfered
with or disrupted in any way (including by vandalism, power failures, natural
disasters, acts of God, civil unrest, strikes, computer bugs or viruses, tampering
or technical failures), the Promoter reserves the right to cancel, terminate,
modify or suspend or recommence the Competition, subject to the approval of the
authorities that have issued permits for its conduct.
32. The Promoter assumes no responsibility for: (i) any error, omission, interruption,
or delay in the operation or transmission of any communication sent to (or by)
the Promoter or any entrant whether caused by problems with communication networks
or lines, computer systems, software or internet service providers, congestion
on any carrier network or otherwise, (ii) any theft, destruction or unauthorized
access to, or alteration of such communications; (iii) any problem with, or technical
malfunction of, any computer system or other equipment used for the conduct of
the Competition.
33. The Promoter assumes no responsibility for: (i) any error, omission, interruption,
or delay in any communication sent to (or by) the Promoter or any entrant or
(ii) any problem with, or technical malfunction of, any computer system or other
equipment used for the conduct of the Competition.
34. CAUTION: ANY ATTEMPT TO CAUSE DAMAGE TO ANY WEBSITE OR THE INFORMATION ON
ANY WEBSITE ASSOCIATED WITH THIS PROMOTION OR TO OTHERWISE UNDERMINE THE FAIR
AND LEGITIMATE OPERATION OF THIS COMPETITION MAY BE A VIOLATION OF CRIMINAL AND
CIVIL LAWS. THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT
PERMITTED BY LAW IN THE EVENT THAT ANY SUCH ATTEMPT IS MADE, WHETHER OR NOT THAT
ATTEMPT RESULTS IN ANY SUCH DAMAGE, INTERFERENCE OR UNDERMINING.
35. All of the Promoter’s decisions are final and no correspondence will
be entered into.
36. The Promoter accepts no responsibility for any tax liability incurred as
a result of an entrant participating in the Competition. Entrants should obtain
independent tax and financial advice.
37. To the full extent permitted by law, the Promoter, its associated companies
and agencies and all those entities' personnel (the "Relevant Parties")
exclude all liability for any loss (including any damage, claim, injury, cost
or expense) which is suffered or incurred by any Eligible Entrant in connection
with the Competition or prizes, including: (i) any indirect, economic or consequential
loss; (ii) any loss arising from the negligence of a Relevant Party; (iii)
any liability for personal injury or death.
38. Each winner consents to the Promoter using their name, likeness, image and/or
voice (including any photograph, film and/or recording of them) in any media
at any time or times without remuneration for the purpose of promoting this Competition,
the Promoter and/or any of the Promoter's products.
39. Entrants' personal information will be collected by or on behalf of the Promoter
to enable it to administer the Competition and publicise its winner(s) and, if
an entrant consents, may be used to market its products to the entrant. The personal
information of each winner may be provided to others assisting in the conduct
of the Competition, including the Competition administrator, prize suppliers
and deliverers, and to regulatory authorities. Persons may contact the Promoter
by post at the address stated in condition 1 to request access to, or corrections
of, any of their collected personal information that is held by the Promoter.
If an entrant does not provide accurate personal information the Promoter may
determine that they are not eligible to win a prize.
